The User expressly accepts that the same will pay all royalties, fees, damages and any other amounts owed to any persons or entities derived from the said User Content having been sent, published or displayed on or through the Website.

The User is liable for ensuring that all the User Content is continually up to date so that it reflects their real situation at all times. II. Publication/Posting rules concerning User Content

The User undertakes to comply with the following rules:
  1. All User Content that the User provides to BESTJOBS must be true and accurate. To this end, the User guarantees the authenticity of all data they may communicate on the Website, and that they have the right or authorisation to provide them.

  2. The User is liable for ensuring that all the User Content is kept continually up to date so that it reflects their real situation at all times. The User will be solely liable for any false or inaccurate declarations they may make and any damages these may cause to BESTJOBS and/or third parties.

The User knows and accepts that use of the Website services takes place under their sole and exclusive liability.

BESTJOBS reserves the right to erase any User Content or part thereof that, in its view, infringes the publication rules set out above or any other undertakings established in these Legal Conditions. If you believe that any User Content breaches the provisions of this section, contact our customer service team so we can analyse it and consider erasing it, where applicable.

The User will be liable for loss and damage of any type that DGNET may incur that is a consequence of intentional or malicious breach of any of the obligations to which The User is subject pursuant to these Legal Conditions and the applicable regulations.

III. Reviews, comments and salaries

On some of its Websites, BESTJOBS offers Users a service where they can review companies and the selection processes they perform; it also offers salary statistics, to try to positively contribute to the job market, and offer a higher level of transparency and appropriate information so that Jobseekers can make an informed decision about the job they are applying for.

The Professional User knows and accepts that on their public profile or business page, and in any job offers they may publish through the same, reviews may also be shown that Private Users have included about the same, where available, based on their current or past employment experience or a selection process they have been through with the said Professional User, as long as the content of the reviews and comments is not offensive, insulting, defamatory or in breach of any of the rules concerning publishing User Content. The BESTJOBS moderation team will monitor for compliance with the above and the Professional User may, where applicable, report the content of such reviews on the Website.

The Professional User must not offer incentives for employees, ex-employees or candidates to leave reviews and/or comments. BESTJOBS will delete any reviews should there be evidence that the reviewers were compensated for leaving their reviews and comments on the Website.

The Professional User must not threaten or coerce anybody into leaving reviews. Reviews are anonymous, which means that the Professional User cannot force BESTJOBS to disclose who has written them and neither can it force its employees, ex-employees or candidates to reveal the content of any reviews they have made.

When leaving reviews and/or comments, Private Users must comply with all the publication rules set out in the preceding section, and all other obligations established in these Legal Conditions.

When a Private User leaves a review and/or comment, this must represent their personal opinion, within the limits established above, without coercion and without following instructions from the company in question.

Private Users are prohibited from requesting incentives (eg gifts or economic remuneration) in exchange for publishing reviews and/or comments.

Furthermore, the Website may offer Users estimated salary statistics for certain posts or job categories. BESTJOBS will obtain the said salary statistics using the salary information published, where applicable, by Professional Users in their job offers. The figures provided by the Website are estimations offered solely for information purposes and the degree of precision may vary. Furthermore, the salary information provided on the Website is for general comparison only. Minimum salaries may vary depending on location and the Jobseeker must always make sure they obtain confirmation from the Employer regarding the real salary for a job offer published.

IV. Third-party content

The Website also offers content from other Users, advertisers and third parties. For these purposes, “Third-party Content” means any authored work or information, including salaries, company reviews, interview reviews, company photographs, responses from Employers, job offers, Employer profile information, adverts, comments, opinions, publications, resumes, messages, texts, files, images, authored works, emails, data and any other materials that you, as User, may find on the Website.

Since we cannot control the said Third-party Content, you, as User, understand and accept that: (i) we are not liable for, nor do we support, Third-party Content, including advertising and information about third-party products and services, job adverts and information related to the Employer, company reviews and selection processes, and salaries provided by other Users; (ii) we do not guarantee the accuracy, recency, suitability, trustworthiness or quality of the information contained in the said Third-party Content; (iii) we do not accept any liability for Third-party Content that is made available by Users, advertisers or third parties and that may be censurable, inaccurate, deceptive or illegal or that breaches these Legal Conditions.

The Website may contain links to third-party websites that we have put up as a service for people interested in this information, or published by other Users or advertisers. Use of any of these links to third-party websites is at the User’s own risk. We do not supervise, or have any control over, third-party websites. To the extent that such links are provided by us, they are provided only for convenience, and a link to a third-party website does not imply our support, adoption or sponsorship of, or affiliation with, the said third-party website.

V. BESTJOBS’ Content

BESTJOBS authorises the User to use the Website for the services and functionalities offered there.

The Website contains content provided by BESTJOBS and our licensees. We and our licensees (including other Users) hold and retain all property rights (including all intellectual property rights) over the content that each of us provides and BESTJOBS holds and retains all intellectual property rights over the Website. If you are a User, we hereby grant a licence that is limited, revocable and that cannot be sublicensed under intellectual property rights capable of licensing by us, so you may view, copy and print the Content of BESTJOBS only for your personal use in relation to using the Website and for the purpose of the same. BESTJOBS does not grant any other licences or consents to use of any type over its intellectual property rights or over any other property or rights related to the functionalities and services offered on this Website.
